A new study Technological Protection Measures and Digital
Preservation: Evidence from video games analyses the impact of copyright the preservation of digital materials. While it focuses on video game preservation, the approach and findings are relevant to understanding the impacts of Technical Protection Measures (TPMs) on all types of digital material, including images, audiovisual works and electronic records that institutions are required to preserve to fulfil their mission.
The report recommends that:
(1) cultural heritage institutions should be able to circumvent TPMs for preservation purposes without having to navigate the cumbersome administrative processes currently imposed by copyright law
(2) that policymakers should weigh the future costs of TPMs against strong protections granted to rightsholders, for example, by requiring that rightsholders maintain and offer robust means for European institutions and researchers to access TPM-protected works into the future.
